Lindsay Lohan ‘not intoxicated’

Lindsay Lohan’s lawyer Mark Heller claims that the star was “clear and lucid” Thursday morning.

The troubled 26-year-old actress was arrested and charged with assault on after slugging Tiffany Eve Mitchell in the face at a New York City nightclub.

Witnesses say that Lindsay was inebriated after drinking excessive amounts of alcohol and using cocaine.

Mark claims that these statements are spurious.

"I can tell you when I was with her this morning, she was in great condition," he told E! News.

"She was certainly not intoxicated, certainly not under the influence of drugs. She was clear [and] lucid, her eyes were clear. No alcohol involvement whatsoever on this occasion."

Mark is out to prove that Lindsay violated no law.

He believes his client is completely innocent and that the third-degree assault charge should be dropped.

"We are going to be working very earnestly to establish that no charges should even be lodged," he said.

"[The police] have already made arrangements to get the video from the...club, which hopefully will reveal some exonerating information. After that, they could just walk away from the case and decline to even prosecute."
