Sofía Vergara has been accused of physical abuse according to legal documents filed by her ex-fiancé Nick Loeb.

The Modern Family actress was engaged to the 39-year-old until May last year. However the former couple have since been locked in a battle about what to do with embryos they froze during their relationship. And now in legal documents filed in August 2014, Nick has accused the actress of “vigorously berating him” after she signed a document regarding the embryos being thawed if one of them died.

“Such abuse was unfortunately common in the Parties’ relationship, as [Vergara] was on many occasions physically, emotionally and mentally abusive to [Loeb],” read the documents, according to Radar Online. “For example, she physically abused him on four separate occasions: she punched him in the face on two occasions, kicked him, and threw her phone at his head.”

The former couple were already in disagreement about the embryos as Nick wants to retrieve them, use a surrogate to deliver them and then raise the children as his own, Sofía is against the plans. While the businessman was unhappy with his former fiancée signing the document at the time, in the court files he claims he reluctantly signed it “even though he did not agree with it, in order to avoid further abuse.”

Additional details claim the 42-year-old routinely “bullied him, calling him a ‘loser,’ ‘worthless,’ and other degrading names” during the four-year relationship.

However an insider told the outlet that Sofía never got physical with Nick.

“It just didn’t happen… Did they fight? Yes, and a lot, which is why they broke up,” they said. “But to portray it as Sofía being mentally abusive towards Nick is reckless, and just not true.”

A representative for Sofía is yet to comment on the claims made by Nick in the legal documents.
